Portugal has one side of its crypto regime settled and one side open. MiCA is a Regulation, so it applies in Portugal without national transposition, and the European Commission describes the EU framework as regulating both the issuing of crypto-assets and the services provided in respect of them.
Portugal is inside the EEA perimeter that an Irish MiCA crypto-asset service provider authorisation is passported into - Kraken holds CASP authorisations from the Central Bank of Ireland and names Portugal among the EEA states it passports them to - so a Portuguese resident is served by an authorised CASP and spot crypto is bought and sold lawfully through one. That is consistent with MiCA applying directly as an EU regulation across the whole Union.
Which authority supervises CASPs domestically in Portugal, and under what national instrument, is unclear.
