Holding and trading spot crypto is lawful in Taiwan and the state taxes the gains, but providing the service is not. Since the amended Money Laundering Control Act took effect on 30 November 2024, any enterprise or person providing virtual asset services must complete anti-money-laundering registration with the FSC before offering them, and providing them without that registration carries up to two years' imprisonment; nine entities had completed registration as of the list published on 22 September 2025. Taiwan then went further than registration: the Legislative Yuan passed the Virtual Asset Service Act on 30 June 2026 and the President promulgated it on 22 July 2026, creating a full licensing regime with seven categories of virtual asset service provider, a stablecoin chapter, minimum capital and an operating bond.

There is no dedicated crypto tax. For an individual, gains on virtual currency that is not securities in nature are property transaction income — sale price less original acquisition cost and related expenses — aggregated into consolidated gross income and taxed at the individual's ordinary progressive rate.
