Owning, buying and selling spot crypto is lawful in Brazil and there is no restriction on individuals holding virtual assets. Leveraged derivatives are a separate question and sit with a different regulator.
Under the securities law, Law 6.385/1976, a security includes “other derivative contracts, regardless of the underlying assets”, which captures perpetual futures and CFDs referenced to crypto; the same law makes distributing and intermediating securities dependent on prior authorisation from the Comissão de Valores Mobiliários. So perps and CFDs are not banned as a product for Brazilians, but they are lawful only when offered through a CVM-authorised intermediary, and an offshore venue that markets them to Brazilian retail without that authorisation is offering them irregularly.
A perpetual on BRENT tracks price and does not confer ownership of the underlying — the same contract mechanics apply in every jurisdiction; what differs by country is legal status and funding rails.

15% IRPF, assessed annually, on income and gains from financial applications held abroad — a category that Law 14.754/2023 defines as expressly including virtual assets and digital wallets. This is the rate that reaches a Brazilian resident trading on an offshore venue. A separate domestic regime for crypto held in Brazil, with progressive capital-gains rates and a small-disposal exemption, is not confirmed here.
