Spot crypto is lawful in Spain, and the question of who may serve a Spanish resident is now settled by MiCA. To provide crypto-asset services anywhere in the EU a firm must be authorised as a crypto-asset service provider under Article 63 of MiCA, or be an already-regulated financial institution — a credit institution, central securities depository, investment firm, market operator, e-money institution, UCITS management company or AIFM — authorised to provide crypto services under Article 60.
A provider licensed in another EU member state may serve Spain once it has obtained its MiCA authorisation there and notified its intention to operate in Spain. The CNMV's own investor page on CFDs describes them generically as leveraged, high-risk, non-standardised products traded off regulated markets, and says nothing about crypto underlyings or about what may be sold to a Spanish retail client.
A perpetual on CRCL tracks price and does not confer ownership of the underlying — the same contract mechanics apply in every jurisdiction; what differs by country is legal status and funding rails.
