What the law actually says

Is gold trading legal in South Africa?

Spot crypto is lawful and licensed. Running a crypto venue for South Africans is a licensed financial-services activity, and a South African holding or trading crypto is doing something ordinary.

The tax authority treats it the same way: SARS says normal income tax rules apply and that taxpayers must declare crypto gains or losses, and since 2 March 2026 the Crypto-Asset Reporting Framework has been in force, obliging CASPs to collect user and transaction data and report it to SARS. Whether crypto perpetuals or CFDs may be offered to a retail South African, under what leverage cap, and whether the crypto-asset declaration reaches derivatives referencing crypto, are unclear.

Leverage is neither banned nor capped for retail here, while the provider must be authorised — and a South African exchange, VALR, openly markets perpetual futures at up to 60x leverage.

What the contract is

A perpetual on GOLD tracks price and does not confer ownership of the underlying — the same contract mechanics apply in every jurisdiction; what differs by country is legal status and funding rails.

Choose Buy / Long, then set size and leverage

Tax note — South Africa

No separate crypto tax. Frequent or business-like trading is taxed as ordinary income at the taxpayer's marginal rate, whose maximum remains 45% for individuals in 2026/27; crypto held as a long-term investment falls under Capital Gains Tax at a maximum effective rate of 18% for individuals. SARS decides which applies from frequency, intent and business-like conduct.
