Spot crypto is legal and the service side is supervised: MiCAR applies directly, and the Austrian accompanying act, the MiCA-Verordnung-Vollzugsgesetz (MiCA-VVG), was passed by the National Council on 3 July 2024 and entered into force on 20 July 2024, naming the FMA as the competent authority. Buying, holding and selling crypto-assets as a retail investor is unrestricted, and market abuse in crypto-assets is prosecuted as an administrative offence under sections 13 and following of the MiCA-VVG, with fines up to EUR 5 million for individuals and EUR 15 million or 15 percent of annual turnover for legal persons.
