Two separate questions with two different answers. Holding, buying and selling spot cryptoassets is lawful in the UK: Bitcoin, Ether and similar tokens sit outside the FCA's regulatory perimeter as 'unregulated tokens' that are not specified investments or e-money, and they can be traded.
Leveraged crypto derivatives are the opposite case: because derivative contracts referencing cryptoassets fall inside the FCA's perimeter, the FCA was able to ban them outright for retail, and did so with effect from 6 January 2021. That ban still stands.
In August 2025 the FCA lifted its parallel restriction on cryptoasset exchange traded notes so that retail consumers can buy cETNs listed on an FCA-recognised UK investment exchange, but the same announcement stated explicitly that the retail ban on cryptoasset derivatives remains in place.
The contract itself does not change by geography: a PEPE perpetual settles in USDC everywhere.

Capital Gains Tax on disposals of cryptoassets. For gains made from 6 April 2026 the rate is 18% within the basic Income Tax band and 24% above it; the annual tax-free allowance for the 2026 to 2027 tax year is £3,000. Crypto received as income (for example employment earnings) is charged to Income Tax first and is not charged again to CGT on that amount.
